Opinion: Tougher porn penalties long overdue – Editorial, Dominion Post

ON MONDAY Justice Minister Judith Collins announced the introduction of a bill to increase the penalties for the production, distribution and possession of child pornography. That same day, according to estimates by the United Nations about 200 new images of children being raped, sexually abused and tortured were circulated around the world.

The Objectionable Publications and Indecency Legislation Bill prepared by Ms Collins will not stop that evil trade. It will, however, help to curb it in New Zealand by putting repeat offenders where they belong – behind bars.

Contrary to the pathetic excuses offered by some who have been caught with child pornography in this country, possessing, viewing, and distributing it is not a “victimless” crime. By definition, its production relies on the sexual abuse and exploitation of children.

Without a demand for images of those sickening acts, that abuse would not occur. Sending the strongest possible deterrent to those who trade in it will help reduce the demand.

Despite the fact child pornography causes such misery, New Zealand courts have shown an inexplicable reluctance to take those who indulge in it out of circulation. According to Ms Collins, only about one in three who are convicted are jailed. Her bill will help address that by creating a presumption of imprisonment for anyone convicted of a second or subsequent offence. It will also double the maximum penalty for the possession, import or export of child pornography from five years’ jail to 10 years and increase the maximum for distributing or promoting such material from 10 years to 14.

The bill will also expand the definition of possessing child pornography so that it includes people who view it on their computers, but do not download the images., That will close a loophole that has allowed some offenders to get away scot-free.

Finally, it will tackle the scourge of adults who use the internet and cell and smart phone technology to groom young people for sex by making it an offence to have indecent communications with anyone aged under 18.

Together with a second bill that will allow the victims of serious sexual and violent offences to have their attackers banned from contacting them or living or working near them. Ms Collins has prepared a suite of changes that will go a long way towards protecting society’s most vulnerable victims.

However, the Government must also put its money where its mouth is. The same day Ms Collins unveiled her intention to get tougher on offenders, sexual violence agencies warned they were struggling to help victims because of funding constraints.

In some cases, young rape victims are waiting up to three months to get a counsellor, depriving them of an important aspect of their recovery from major trauma.

Social Development Minister Paula Bennett has ordered a nationwide review into where funding for such services comes from, and where it actually goes. Like the measures Ms Collins is proposing, that work cannot be completed soon enough.

“Scurrilous magazine Truth”: “chocker with sex adds” promoting “people trafficking” – says Peters

NZ First Leader Winston Peters has labelled Auckland “the supercity of sin”, highlighting its flourishing prostitution industry and “that scurrilous magazine Truth” with its many advertising links to the trafficking of sex workers.

“The Hong Kong born Chow brothers are thoughtfully providing a 15-storey brothel, in what used to be an historic building, just across the road from the casino in the heart of Auckland,” Peters said.

“And thanks to our generous student and worker visa schemes the Chow brothers will be able to provide genuine home-grown sex workers for the visitors if that’s what they want.”

He said “that scurrilous magazine Truth” was “chocker with sex ads” most based in Auckland. Many of the advertisements “in reality represent people trafficking”.

“The seven deadly sins were alive and well in Auckland and the city was being trashed economically, socially, physically and ethically,” he said.

On 25 February 2011 Truth Publications Ltd, formerly directed by Dermott Mallet and John Andrew Pin, was struck off the Register of Companies. It had earlier been put into liquidation on 21 October 2009 owing $622,000 to creditors, according to the Liquidator’s reports.  Dermott Malley and John Pin were both directors and indirect shareholders in Truth Publications Ltd.

The scurrilous tabloid “NZ Truth”, which the failed company had published, made much of its money through advertising Adult Services (prostitution etc) and marketing hardcore porn linked to Steve Crow’s porn companies.

On 21 March 2011 the domain name NZXESCORTS.CO.NZ was registered with the New Zealand Domain Name Commission (DNC) by Dermott Malley. The registrant name was recorded as “Truth Publications Ltd” and Mr Malley recorded his name and the defunct company’s email as “registrant contact” and “administrative contact”. In early June 2011 the DNC was alerted to these false entries and the registrant was changed to Truth Weekender Ltd, with sole director Dermott Malley (contact details were corrected to comply with the law).

The registrant for the domain name NZESCORTS.CO.NZ and truth.co.nz is now Truth Media Network, P.O. Box 204367 Highbrook, Auckland 2161.

It would appear that the “scurrilous magazine Truth” continues to be closely linked to the prostitution industry, Dermott Malley, Steve Crow and his brother David Crow.

On 5 June 2011 The NZ Herald reported that Steve Crow, a banned company director, had announced a new business venture NZX Escorts.

“One week after pleading guilty to directing a company while banned, porn magnate Steve Crow has announced a new business venture. …

“He maintained his involvement as a “marketing consultant” in the new venture did not contravene his director ban. “I’m not running it. David Crow my brother is. He’s the CEO.”

The lessons of the Kermit Gosnell verdict – by Justin Dyer

Justin Dyer, an assistant professor of political science at the University of Missouri in Columbia, wrote in The Kansas City Star special report:

“After the sensational murder trial of Pennsylvania abortion doctor Kermit Gosnell, a curious thing happened to American public opinion: nothing at all. According to a new Gallop poll, Americans remain divided into the same basic camps with respect to abortion rights.

“Gosnell’s crimes — which include killing three post-birth infants and negligently administering a lethal dose of Demerol to a 41-year-old Nepali refugee — had no effect on Gallup’s poll numbers, which have remained constant since the 1970s. Given the case’s sordid and heart-wrenching details, Gallup’s seeming non-story (“public opinion same as always”) is significant.”

Convicted sex offender – a school principal who identifies as “bisexual” – and the NZ Teacher’s Council register

The Herald on Sunday reported on 1 August 2010. “A convicted offender is still registered on the New Zealand Teachers Council website despite being convicted for molesting boys in two different schools in the early 1990s…. Elvis Dobson Shepherd was suspended  on full pay in November 2007 after being charged with sexually abusing students at both Hato Paora (St Paul) College [at Chelterham in Feilding] and Hato Petera College [in Northcote] Auckland.”

Mr Shepherd’s teacher registration was eventually cancelled and he was placed under “censure” after he was sentenced to a jail term of eight years and four months in September 2010. Just over two-and-a-half  years later he is now up for a parole hearing -reported two days ago 20/05/2013].

Stuff News reported on 31 July 2010, after a name suppression order for the sex offender was lifted:

“The sexual encounters between Elvis Dobson Shepherd and two teenage boys occurred while he was teaching and living at Hato Petera College, a Maori Catholic boarding school on the North Shore.

“The 49-year-old, [also known as Tihirau Shepherd], who identifies as bisexual, was also a student at the school before returning to teach te reo Maori in an experimental total immersion unit in 1989.”

The Herald on Sunday report stated:

“Elvis Dobson Shepherd was found guilty of four indecent assault charges against two teenagers in the High Court at Palmerston North on Friday [30 July 2010].

“The offences took place while Shepherd was teaching at Hato Petera College, a Maori Catholic boarding school on Auckland’s North Shore.

“Shepherd found employment at Maori boarding school Hato Paora near Palmerston North despite allegations of sexual encounters with boys at his previous post.

“Former Hato Petera trust board member Ashley Balls said Shepherd ‘deserted his post’ before the allegation was properly investigated. He then became deputy principal of Hato Paora in Feilding in 2002.

“Balls said he called Hato Paora to warn them about Shepherd’s past when he found information about the incident in the school files years later.

“But Hato Paora took no action and in 2007 two students came forward with allegations of sexual abuse. The school investigated, but found there was no case to answer.

“However, the Ministry of Education suspended Shepherd in November 2007.

But Balls said it was “odd” that the Teachers Council still had Shepherd listed on full registration. Balls described the situation as “political correctness gone mad”.

” ‘They couldn’t take the complaint to the Teachers Council because they hadn’t got anything provable’.

“Minister of Education Anne Tolley said she had complete confidence in the processes that would be followed by the Teachers Council to ensure Shepherd was never allowed in a classroom again. She said the Government also recently introduced much greater protection by passing data-matching laws which would mean this man would be identified if he ever sought employment at a school.

“In June, the Herald on Sunday revealed that three teachers who were sacked or quit over misconduct were still registered to teach on the official database that was supposed to warn parents and schools. The teachers kept their legal right to work in a classroom despite complaints to the New Zealand Teachers Council.”

Parole Board postpones hearing on sex offender – former school principal

A former school principal imprisoned in 2010 for more than eight years for sexually abusing students could be released as early as August.

Elvis Dobson Shepherd, 52, was found guilty on two counts of sexual violation by oral sexual connection and two counts of indecent assault while he was teaching and living at Hato Petera College, a Maori Catholic boarding school on Auckland’s North Shore, in the early 1990s.

At the time of his sentencing in 2010, Shepherd was principal of Feilding’s Hato Paora College and was promoted to the position despite warnings from Hato Petera.

He was also charged with sexual abuse against Hato Paora students, but two separate juries could not reach verdicts in relation to some of the charges while he was found not guilty of others.

When sentenced Shepherd’s continued lack of remorse and denial of the proven charges was noted.

In a parole decision released to The Dominion Post,  the board noted there were still “question marks” over Shepherd’s insight into his offending.

“For example, the psychologist referred to his limited empathy for the welfare of the victims and an overemphasis on meeting his own needs, which were said to have been likely to have precipitated the offending.”

A psychological assessment report put Shepherd’s overall risk at medium low, with reference made to a lack of capacity for relationship stability, and deviant sexual preferences.

But a comprehensive proposal put forward by Shepherd and his whanau, which involved him completing the SAFE Programme for sexual offenders while in the community had merit, it said.

However, the address put forward for Shepherd to reside at had not been put to probation for consideration so could not be considered.

The Parole Board postponed its hearing until August 1 so Shepherd’s whanau could organise a hui with probation, the SAFE network and other interested parties so discussion could take place about the release proposal and his acceptance of the offending.
