Paedophile may remain a risk

The Crown is having second thoughts about its decision not to seek an open-ended preventive detention sentence for a 39-year old man [name removed] who disclosed more sex offences involving children, while he was undergoing treatment in prison.  He disclosed 16 sex charges against eight young girls while doing the Kia Marama sex offenders’ programme in Christchurch Men’s Prison.

After his guilty pleas, the Crown decided not to seek preventive detention but it has been rethinking that decision after access was barred to reports on his treatment at the programme.  Without those reports, the Crown faced a difficult assessment of any future risk to the community that the offender might pose.

In court today, the offender agreed to allow access by the Crown and his defence counsel to reports prepared on his treatment after the crown prosecutor sought a direction on the matter from Christchurch District Court Judge David Saunders.

The offender has a history of offending stretching back 20 years and the latest offences for which he now faces sentencing were committed from the 1990s to 2005 in Timaru.

He is seen as having a deeply entrenched sexual attraction to children, and is assessed as a high-risk pornography offender.

He is serving a two-year four-month term imposed in May last year for possession of objectionable material including images of bestiality and child pornography.

Registered charity challenges Court of Appeal’s child porn ruling

Stop Demand Foundation, a registered charity (CC 30599) with the Charities Commission, has attacked a Court of Appeal decision granting name suppression to a 50-year old Manawatu man found guilty of possessing images of child rape. The charity’s founder, Denise Ritchie, who was interviewed on TV One’s Breakfast programme about the matter this morning, says the Court’s decision is a blow to child rape victims in New Zealand and to lobby groups like hers around the world fighting sexual violence against children.

The Manawatu man, who admitted 21 charges of possessing objectionable material, was sentenced to six months home detention and fined $5250 at the end of last year.

In a decision only made public yesterday, the Court of Appeal ruled that his name should be kept completely secret to protect his family members.

Ms Ritchie, who has read and studied the decision, pointed out on TV One’s Breakfast programme that the convicted man has not lived with or had close association with any of the “family members” whose reputations and privacy the Court of Appeal Judges have sought to protect. She argues that granting name suppression to the offender merely to protect the reputation of these people sets a dangerous precedent. [Read more…]

Deregistration of Porn Teacher Appropriate – Family First

In its Media Release today, the highly respected registered charity Family First NZ has welcomed the decision by the New Zealand Teacher’s Council to deregister a female primary school teacher for her “serious misconduct”  – involving her work as a porn magazine model (See 35 page decision The Complaints Assessment Committee v Rachel Kellie Whitwell. NZTDT 2011/7). 

The Teachers Disciplinary Tribunal ruled that the defendent, aged 29, must meet the CAC’s actual and reasonable cost associated with the disciplinary proceeding and pay half the Tribunal’s costs.  

“Teachers have a special status as leaders and should be respected – especially by our children,” says Bob McCoskrie, National Director of Family First NZ.

“Modeling and selling naked photos to a pornographic magazine doesn’t meet that standard. Associating the photos with her profession of teaching children is also unacceptable.

“These sexually explicit photos of the teacher have been published and are now in the public domain. The combined role of porn star and primary school teacher simply doesn’t fit for many families. Parents would be just as concerned if a teacher was coming to school topless or teaching that pornographic magazines are harmless. [Read more…]

LA Zombie – Herald on Sunday reporter seeks responses

Here is the email received by the Society for Promotion of Community Standards Inc. (SPCS) from Herald on Sunday reporter Andre Hueber on Friday April 29, 2011 at 10.38 AM regarding LA Zombie, a film we were told was that was prevented from being screened at the Melbourne International Film Festival in July 2010. The Festival organisers had proposed to screen it, but the necessary ‘exemption’ for screening an unclassified film was not granted in that instance (pers. comm. Paul Tenison, Acting Applications Manager, Classification Branch, Australian Attorney General’s Department).

‘Sick puppy’ saw porn in prison before murder

It was an ”indictment” on the system [Dept of Corrections] that someone like [Malcolm] Chaston [now a convicted murder] could source objectionable material [pornograhy] while behind bars. ”It is hugely irresponsible and a disgrace,” he [Garth McVicar – Sensible Sentencing Trust Founder] said.

WHITE SUPREMACIST Malcolm Chaston was allegedly able to watch soft-porn movies before being released from prison and murdering young mother Vanessa Pickering.

Chaston will be sentenced on Monday on the murder charge and also of the sexual assault of another female.

Sensible Sentencing Trust founder Garth McVicar has released an email sent to him from a prison guard in the months leading up to Chaston’s prior release from jail in mid-2008.

The unnamed guard wrote of Chaston: ”He is a very sick puppy and these sex movies just feed his sickness.

”He watches these movies and skites about things he is going to do when he gets out.

”This is a very sick place, can you imagine why they would let sex offenders watch sex videos. God help us and the poor woman these mongrels come across when they get out.”

The email stated: ”I wonder if you are aware that the Dept of Corrections has recently decided that R16 videos and DVDs are OK to be shown in prisons.

”There is no distinction as to what type of R16 is shown to what type of prisoner _ i.e. a soft porn R16 can be shown in a sex offenders unit, and R16 with violence can be shown to violent prisoners.

”Can you imagine what these videos do to mongrels like Malcom [sic] Chaston …”
