A banned company director with a chequered business past and who has threatened many New Zealanders with court action, is shortly to face a battle in court over his business activities.The Deputy Registrar of the Companies Office, Peter Barker, called for a “substantial” period of probibition to be imposed on this gentleman: he is currently banned from directing, promoting or managing a company. However, despite the ban – it is business as usual as far as he is concerned.
He continues to pursue what commentators are suggesting is whimpish ‘Fingers in the Till’ ‘business’ chicanery, without enforcement agencies being able, thus far, to reign him in.
It’s all perfectly legal he or his lawyer retorts when his business activities are challenged. Such a ‘defence’ is reminiscent of leading politicians caught like proverbial ‘possums in the glare of the moral headlights’, who cry out “I’ve done no wrong … I’ve broken no law!”. Then when public controversy erupts over their activities, they resign or are forced to resign so they can deal with the fall-out.
Yes politics IS a grubby little business (like peddling porn, prostitution and money laundering).
What moral authority, if any, are such politicians who claim innocence of ‘wrong doing’, appealing to? The Courts, the Companies Office, or the Securities Commission? Surely it’s not the Court of public opinion or that of a ‘Higher Power’? God forbid it!
Directors of companies promoting hardcore porn and the prostitution may well argue that they are operating within the law because these ‘industries’ are legal. However, the vast majority of New Zealanders find these ‘industries’ morally corrosive, putrid, repugnant, and injurious to the “public good” and contend that this argument based on legality, is philosophically bankrupt.
It’s significant that when some company directors are banned by an Order issued by the Registrar of Companies, they refuse to comply with it, employing all manner of chicanery to foil the enforcement agencies. Why? Because they have little respect for the law, whether it be the moral law or any other law.
