Dave Henderson seeks bankruptcy discharge: Official Assignee objects in public examination

Dave Henderson‘s business career is under scrutiny in an inquisition in the High Court in Christchurch.

Christchurch businessman Dave Henderson says payments to his credit card worth $91,000 while he was bankrupt were loans or gifts from a trust and not income.

Henderson, 60, is under public examination in the High Court in Christchurch before Associate Judge Rob Osborne to decide if he can be discharged from bankruptcy.

Henderson was adjudicated bankrupt in November 2010, with self-acknowledged debts of about $142 million.

The Official Assignee (OA) objects to his discharge and alleges he has not disclosed income and not co-operated with the OA during the bankruptcy. [Read more…]

Judge blasts Fonterra for putting productivity ahead of the environment

An Environment Court judge has criticised Fonterra for putting productivity ahead of the environment and said its failure to lead by example is not helping the industry…. “Fonterra should be an industry leader, not a laggard, in regard to the adoption of appropriate technology to avoid environmental effects.”

The comments by Judge Jeff Smith are included in sentencing notes published on Tuesday in relation to offending by Fonterra between September last year and April.

The co-operative was fined $174,150 after pleading guilty to six charges related to its Edgecumbe plant near Whakatane, in a prosecution brought by Bay of Plenty Regional Council. Four convictions related to wastewater discharges from the plant entering waterways and groundwater through an irrigation system……

Dave Henderson’s business affairs under High Court probe

Dave Henderson – a former high-flying property developer – has been accused of misrepresenting his personal financial position in documents supporting loan applications.

Henderson, 60, is under public examination in the High Court in Christchurch before Associate Judge Rob Osborne to decide if he can be discharged from bankruptcy and, if so, under what conditions.

Henderson was adjudicated bankrupt in November 2010 with self-acknowledged debts of about $142 million.

He was due to be automatically discharged from bankruptcy in January last year but the discharge was opposed by the Official Assignee. The court will ultimately decide. The businessman was also bankrupted in 1996.
